“Mother and Uncle Sentenced to Jail for Child Rape”

A mother who committed sexual assault against her daughter and allowed her brother to rape the child has been sentenced to jail for her “depraved and cruel” actions.

Both the woman and her brother, who is the victim’s uncle, received a 15-year prison term. The rape occurred when the woman brought her brother into a bedroom where the child was watching television and allowed him to rape her while she watched. The victim testified that she believed this incident took place on the man’s birthday. The woman, in her 50s, denied 14 charges, including 13 counts of sexual assault and one of rape.

She was found guilty by a jury in the Central Criminal Court on two counts of sexual assault between January and September 2001 and the charge of rape, which involved facilitating the rape of her child, in March 2003. The child was four years old when she was sexually assaulted by her mother in their shared bed, as reported by the Irish Mirror.

The man, in his 40s, denied six rape charges and was convicted of one count of rape in March 2003.

The jury could not reach a verdict regarding a third defendant accused of orally raping the girl. The charges against him were later dropped as the Director of Public Prosecutions decided not to pursue another trial against him.

Both the victim’s mother and uncle maintain their innocence and do not accept the jury’s decision.

During sentencing, Ms Justice Eileen Creedon praised the victim for her bravery in coming forward about the abuse, especially involving her own mother.

The judge described the mother’s actions as particularly cruel, egregious, and depraved, noting that she allowed her child to be raped by her uncle while she watched. The abuse inflicted on the defenseless child by both perpetrators was highlighted for its extreme cruelty and depravity.

Ms Justice Creedon imposed a 16-year headline sentence for both offenders but reduced it by one year due to their lack of remorse or acknowledgment of their crimes. They were both sentenced to 15 years in prison, with the sentences backdated to their initial custody.

The victim shared in her impact statement how the abuse has affected her mental health, leading to PTSD, anxiety, and depression. She expressed her journey from feeling broken to becoming a survivor by speaking out against the abuse.

The local investigating officer confirmed that when the mother was arrested, her other children were taken into state care.

Both defense counsels highlighted the dysfunctional family environment and alcohol issues in the household. They argued for leniency based on lack of previous convictions, lack of remorse, and the impact on reputation and family.

The court considered the severity of the crimes, the victim’s young age at the time of the abuse, and the betrayal of trust in sentencing the perpetrators.
